Acceptance of Terms & Conditions

By using the AudioBooks4Hire.com Ltd Web site, you accept and agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you should not use the AudioBooks4Hire.com Ltd Web site. In the event of any breach of these Terms and Conditions, your permission to use the Websites will automatically terminate.

Changes to Terms & Conditions

These Terms and Conditions can only be varied by AudioBooks4Hire.com Ltd in writing.

AudioBooks4Hire.com Ltd. reserves the right, from time to time, with or without notice to you, to change these Terms & Conditions at its sole discretion. The most current version of these Terms & Conditions can be reviewed by clicking on the "Terms & Conditions" hyperlink located at the bottom of most pages of the AudioBooks4Hire.com Ltd Web site. The most current version of the Terms & Conditions will supercede all previous versions. Your use of the AudioBooks4Hire.com Ltd Web site after changes are made means that you agree to be bound by such changes.

Membership and Billing

You can find the specific details regarding your subscription with AudioBooks4Hire.com Ltd, including your next billing date, at any time by clicking on "My account", located at the top of the pages of the AudioBooks4Hire.com Ltd Website.

You may choose from one of the three following options:

'Starter' Package - monthly fee of £4.99 per month enabling members to rent up to 6 audio books per year (equivalent to 1 book every 2 calendar months)
'Basic' Package - monthly fee of £6.99 per month enabling members to rent up to 12 audio books per year (equivalent to 1 book every calendar month).
'Advanced' Package - monthly fee of £13.99 per month enabling members to rent up to 24 audio books per year (equivalent to 2 books every calendar month).

Free Trials/Special Offers/Price Discounts

In the event of AudioBooks4Hire.com Ltd running a free trial promotion the following terms will apply to that free trial in addition to the terms set out herein:

Free trials are only available to new subscribers of AudioBooks4Hire.com Ltd and at AudioBooks4Hire.com's sole discretion. Such trials shall be valid for one calendar month. Previous subscribers or trialists do not qualify for a free trial. Only one free trial may be redeemed per household and a free trial may not be combined with any other offer. You must have internet access and a valid debit/credit card to redeem a free trial offer.

Upon registering for your free trial, your debit/credit card will be charged for one month at the appropriate rate according to the package chosen. Such charge will then be refunded upon our safe receipt of the audio books hired in a satisfactory condition. We reserve the right to charge for any audio book lost or damaged in accordance with these Terms and Conditions.

We will begin billing your credit card for monthly subscription fees for the AudioBooks4Hire.com Ltd service at the end of your free trial period unless you cancel prior to the end of your free trial. We will continue to bill your debit/credit card on a monthly basis for the AudioBooks4Hire.com Ltd service until you cancel.

You must cancel your account before the end of your free trial period to avoid charges to your card. For instructions on how to do this, see the section on 'cancellation' below.

During a free trial you will receive a full service from AudioBooks4Hire.com Ltd, with the exception that titles are delivered exclusively to paying subscribers within the first four weeks of the title's audio book release date, however you will be free to reserve the titles in the normal way. These restrictions will be lifted upon expiry of 4 weeks from the release date or payment of the first monthly installment, whichever is the sooner. For the avoidance of doubt, recipients of gift subscriptions will not be affected by these provisions.

From time to time, AudioBooks4Hire.com Limited may operate price discount offers. These offers are at AudioBooks4Hire.com Ltd's sole discretion and may be withdrawn at any time without prior warning.

From time to time, AudioBooks4Hire.com Limited may operate a 'Recommend a Friend' Special Offer to reward a member (the 'Introducer') who introduces another member (the 'New Member') to AudioBooks4Hire.com Limited. The Introducer will then benefit from an increased rental allowance of audio books for a period of two months from the date of the New Member joining AudioBooks4Hire.com Limited, in accordance with the Introducer's current subscription level as detailed below:

Introducers who subscribe to the £4.99 per month package may rent up to 2 books for the two calendar months directly following the New Member's subscription to AudioBooks4Hire.com Limited
Introducers who subscribe to the £6.99 per month package may rent up to 4 books for the two calendar months directly following the New Member's subscription to AudioBooks4Hire.com Limited
Introducers who subscribe to the £13.99 per month package may rent up to 8 books for the two calendar months directly following the New Member's subscription to AudioBooks4Hire.com Limited

The additional rental allowance applicable to the 'Recommend a Friend' special offer is however subject to the New Member subscribing to AudioBooks4Hire.com Limited for at least 4 calendar months, book availability, postage delivery lead-times and speed of book return. Please also note that in accordance with our standard Terms and Conditions, subscribers will only be sent one book at a time.

Membership Gift Vouchers

AudioBooks4Hire.com Ltd gift vouchers are non-refundable and non-transferable. Once redeemed against the purchased gift level it is not possible to transfer the gift amount to any other membership levels. The membership will run for the agreed gift voucher time period (12 months or a bespoke time as agreed with AudioBooks4Hire.com Ltd).After this time the membership will cease unless AudioBooks4Hire.com Ltd is instructed otherwise and receives further payment details. AudioBooks4Hire.com Ltd will contact the member 1 month prior to the membership ceasing to inform them. Once a gift voucher is redeemed the resulting member is subject to all of the usual terms and conditions of service.

Billing

As a subscriber to AudioBooks4Hire.com Ltd, you agree that we are permitted to charge your debit/credit card a monthly subscription fee and any other charges that you may incur in connection with your use of AudioBooks4Hire.com Ltd. The subscription fee will be billed at the beginning of your subscription and on each monthly renewal thereafter unless and until you cancel, and regardless of how much you use the service. We will automatically charge your debit/credit card each month on or after the calendar day corresponding to the commencement of your membership. All fees and charges are non-refundable. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email. If you wish to use a different credit card or if there is a change in your card validity or expiry date, you may edit payment details by clicking on "My account", available at the top of most pages of the AudioBooks4Hire.com Ltd Website.

Automatic renewals

Your AudioBooks4Hire.com Ltd subscription will be automatically renewed on a monthly basis. For your convenience, we will charge the monthly subscription fee to the debit/credit card you provide to us during registration (or to a different card if you change your account information). Your membership will automatically renew for successive monthly subscriptions, without prior notice to you, unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews in order to avoid billing of subscription fees to your debit/credit card.

Account changes

You may upgrade or downgrade your AudioBooks4Hire.com Ltd subscription as often as you like, within the 'My account' section of the AudioBooks4Hire.com Ltd Website. Any reduction in your monthly bill will take effect at the next billing period after any outstanding audio books have been returned to us. Any increase in your monthly bill resulting from an upgrade will take effect immediately, being pro-rated to the remainder of your billing period, and the increase may be charged immediately (without changing any subsequent billing dates).

Delivery and return of Audio books

We currently use the Royal Mail, first-class postage prepaid, to deliver and return the Audio books you have selected to read. Actual delivery times may vary for you depending on (i) our stock availability, (ii) your delivery address, (iii) when you make your selection and (iv) circumstances impacting delivery by the Royal Mail. Please notify us if an audio book you have selected is not received within 20 days.

You agree to treat the audio books and their associated packaging with the utmost care at all times. You agree that you may need to compensate AudioBooks4Hire.com Ltd for any audio book lost or returned in an unacceptable condition (beyond reasonable wear and tear) - and that you allow AudioBooks4Hire.com Ltd to charge such compensation to your debit/credit card. We will notify you of any such charges. AudioBooks4Hire.com Ltd reserve the right to charge the replacement cost for any audio book which is lost or damaged.

Cancellation

As noted above, you may cancel your subscription to AudioBooks4Hire.com Ltd at any time. To cancel, click "My account" and follow the instructions under the heading "Cancel my subscription." Immediately upon cancellation, no further Audio books will be dispatched to you. We do not provide refunds or credits for any partial monthly subscription periods. Upon cancellation, you will be given seven (7) days to return any outstanding audio books. Failure to return such audio books within these 7 days will result in your credit card being billed £1 per audio book per day late (including weekends and public holidays), up to a maximum of £20 per audio books. To avoid problems, we advise obtaining a certificate of posting when you return our Audio books to us.

Account access

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. In order to provide you with an easy-to-use service, AudioBooks4Hire.com Ltd will place a 'cookie' (a small text file) on any computer you use to access the AudioBooks4Hire.com Ltd Website. When you revisit the AudioBooks4Hire.com Ltd Website, this cookie will enable us to recognize you as the account holder and provide you with direct access to your account without requiring you to retype any password or other user identification.

Disclaimers of warranties and limitations on liability

The headings in this Terms and Conditions are for convenience only and shall not affect interpretation.

Reference to any statute or statutory provision shall include a reference to such statute or statutory provision as may be amended from time to time.

These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties submit to the exclusive jurisdiction of the Courts of England and Wales .
